1. Agreement to these Terms
1.1 Who we are. REI Cash Index is a product of In House Lead Gen LLC, a Wyoming limited liability company ("REI Cash Index", "we", "us" or "our"). "You" means the person or business using the Service.
1.2 What these Terms cover. These Terms and Conditions ("Terms") govern your use of reicashindex.com, the members area, our free tools, our API, and every membership, ad kit, course and other product we sell (together, the "Service").
1.3 Acceptance. By creating an account, making a purchase or using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service.
1.4 Arbitration notice. SECTION 19 REQUIRES MOST DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, NOT IN COURT, AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU CAN OPT OUT WITHIN 30 DAYS AS DESCRIBED IN SECTION 19.6.
1.5 Business use. If you use the Service for a company, you confirm you have authority to bind that company, and "you" includes it.
2. The Service
2.1 What it is. REI Cash Index is a market research tool for real estate wholesalers and investors. Members get rankings and market data for roughly 2,500 U.S. cities. The data includes cash sales, days on market, months of inventory, average sale price, population, and estimated advertising cost per lead.
2.2 Tools. The members area may include filters, strategy lists, rankings and city-list exports formatted for advertising platforms. Features can differ by plan and can change over time.
2.3 Free tools. We may offer free tools, such as a city report, a cost-per-lead lookup and a list of top cities. Free tools have usage limits and may ask for your name, email or phone number. We can change or remove them at any time.
2.4 Other products. We also sell one-time digital products, such as Facebook and Google ad kits and training courses, and an optional API add-on. Sections 6 and 8 cover those.
3. Eligibility and accounts
3.1 Who can use the Service. You must be at least 18 years old and able to enter a binding contract. The Service is intended for business use in the United States.
3.2 Your account. Give us accurate information and keep it current. You are responsible for everything done under your login. Keep your password private and tell us right away at support@reicashindex.com if you suspect someone else has used your account.
3.3 One user per membership. Each membership is for one person. Do not share your login, and do not let a team, client or anyone else use it. If more than one person needs access, each needs a separate membership.
3.4 One membership per account. You may hold one membership per account. First-time customer pricing is limited to one per person and one per business.
3.5 Monitoring for sharing. We may watch for signs of shared or automated use, such as logins from many locations or devices. If we find it, we may warn you, require a password reset, or suspend or end the account under section 18.
4. Membership billing and automatic renewal
4.1 Plans and prices. Membership prices on the effective date are below. The price and terms shown at checkout control if they differ.
| Plan | Price (USD) | Renews |
|---|---|---|
| Monthly | $49 per month | Every month |
| Monthly, first-time customer offer | $29 for the first month, then $49 per month | Every month |
| Annual | $349 per year | Every year |
4.2 Automatic renewal. YOUR MEMBERSHIP RENEWS AUTOMATICALLY AT THE END OF EACH BILLING PERIOD, AND WE CHARGE YOUR PAYMENT METHOD THE THEN-CURRENT PRICE, UNTIL YOU CANCEL. To avoid the next charge, cancel before the renewal date as described in section 5.1.
4.3 Payment authorization. When you subscribe, you authorize us and our payment processor to charge your payment method for the first period and each renewal, plus any applicable taxes. A third-party payment processor handles card details; we do not store full card numbers.
4.4 Failed payments. If a charge fails, we may retry it and may suspend access until payment succeeds. We may end a membership that stays unpaid.
4.5 Renewal reminders. We email a reminder before each annual renewal. Monthly plans renew without a separate reminder.
4.6 Price changes. We may change membership prices. We will email you at least 30 days before a new price applies to you. It takes effect at your next renewal after that notice, and you can cancel before then.
4.7 Taxes. Prices do not include sales tax or similar taxes unless stated. Any tax due is added at checkout.
4.8 Promotions. Discounts and promotional prices apply only as described in the offer and cannot be combined unless we say so.
5. Cancellation and the 7-day guarantee
5.1 How to cancel. You can cancel at any time from your account's billing page or by emailing support@reicashindex.com from your account email. We confirm cancellations by email.
5.2 When cancellation takes effect. Your membership stays active until the end of the period you already paid for, then it ends and you are not charged again. We do not refund or credit a partial period.
5.3 7-day money-back guarantee. If you are not satisfied, email support@reicashindex.com within 7 days of your first membership payment and we will refund that payment in full. Your membership ends when the refund is issued.
5.4 Limits on the guarantee. The guarantee applies once per person and once per business, and only to the first payment on a first membership, monthly or annual. It does not apply to renewals, a membership you restart, API access, ad kits, courses or any other purchase. We may decline it where we find fraud, account sharing or a breach of section 7.
5.5 All other charges. Except for the guarantee in section 5.3, the cases listed in our Refund Policy, or where the law requires a refund, all membership charges are final.
5.6 Chargebacks. Contact us before disputing a charge with your bank so we can fix the problem. We may suspend an account while a chargeback is open.
6. Ad kits, courses and other one-time purchases
6.1 What they are. Ad kits are digital files such as ad text, ad images, audience targeting methods, keyword lists and negative keyword lists. Courses are online training. The product page describes what each one includes.
6.2 Delivery. Digital products are delivered electronically, to your account or by email, after payment clears. Nothing is shipped.
6.3 All sales final. Because digital products are delivered immediately and cannot be returned, ad kits, courses and other one-time purchases are non-refundable, except where the law requires a refund or as stated in our Refund Policy.
6.4 License to use them. When you buy an ad kit or course, we grant you a non-exclusive, non-transferable license to use it in your own business's advertising and training. You may edit kit materials for your own ads.
6.5 What you may not do. You may not resell, share, publish, give away or sublicense any kit or course, in whole or in part. You may not use them to build a competing product. Agencies and freelancers need our written permission before using a kit in client accounts.
6.6 Courses. Course access is for the buyer only. Do not share logins, or record, download or redistribute course content unless we provide a download for that purpose.
6.7 Platform rules. Ad platforms change their policies and may reject or limit any ad. Section 12 explains your responsibility for the ads you run.
7. Your license and acceptable use
7.1 License. While your membership is active and you follow these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service for your own internal business use.
7.2 What you can do with the data. You may view the data, filter and rank it, and export city lists to plan and run your own marketing and acquisitions.
7.3 What you cannot do. You agree not to:
- resell, republish, share or redistribute our data, rankings, lists or exports, whether free or paid;
- copy the dataset, or a substantial part of it, to build or improve a competing product, dataset or service;
- scrape, crawl or use bots or other automated means to access the Service, except through our API under section 8;
- get around usage limits, rate limits, email gates, copy protection or other technical controls;
- share your login or let anyone else use your account;
- reverse engineer the Service or probe it for vulnerabilities without our written permission;
- use the Service to break any law, or to send unlawful calls, texts or emails;
- use our data to train a machine learning or AI model offered to others.
7.4 Usage limits. We may set reasonable limits on searches, exports, API calls and other activity, and may change them.
7.5 Consequences. If you breach this section, we may suspend or end your account without a refund, and you remain responsible for any harm caused.
8. API access
8.1 Add-on. API access is an optional paid add-on that lets your own CRM or automations read city data. It needs an active membership and is billed as shown at checkout. Sections 4 and 5 apply to its billing and cancellation.
8.2 Keys. Keep your API key secret. You are responsible for all use of it. Tell us right away if a key is exposed so we can replace it.
8.3 Permitted use. Use the API only inside your own business systems. Do not expose API data to third parties, resell it, or use it to build a product that competes with the Service.
8.4 Limits and changes. The API has rate limits. We may change, version or retire endpoints, and we will try to give reasonable notice of breaking changes. We do not promise any level of uptime.
9. Data, rankings and estimates
9.1 Where the data comes from. We compile the Service's data from third-party and public sources and from our own analysis. We update it periodically, usually monthly. It is a snapshot, not a live feed.
9.2 Accuracy. Data can be incomplete, out of date or wrong. Some cities are missing some fields. Sources can change or correct their figures after we publish. We do not guarantee the accuracy, completeness or timeliness of any data.
9.3 Rankings are opinions. Rankings, scores, tiers and color ratings reflect our own methods and judgment. They are not statements of fact about how any market will perform, and we may change the methods at any time.
9.4 Cost-per-lead figures are estimates. Advertising cost figures, including cost per click and cost per lead, are estimates. They are not quotes, and they are not a promise of what you will pay. Your actual costs depend on your ads, offer, budget, competition, timing and the ad platform.
9.5 Verify before you act. Check any figure that matters to a decision against your own research before you spend money or sign a contract.
10. No professional advice
10.1 Information only. The Service, ad kits and courses are informational and educational. They are not financial, investment, legal, tax, real estate or accounting advice.
10.2 No broker or agency relationship. We are not acting as your real estate broker, agent, attorney, financial advisor or fiduciary. Using the Service does not create any such relationship.
10.3 Your compliance. Real estate wholesaling, assignment of contracts and seller marketing are regulated differently in each state and city. You are responsible for knowing and following the laws that apply to you. That includes licensing and disclosure rules, fair housing laws, and rules on calls, texts, mail and email.
11. No guarantee of results
11.1 Results vary. We do not promise leads, contracts, deals, assignment fees, income or any return on ad spend. Real estate and advertising carry risk, and you can lose money.
11.2 Examples and testimonials. Deal examples, closing statements, assignment fees, case studies and testimonials shown on the site are individual results. They are not typical and do not predict what you will achieve.
11.3 Your decisions. You alone decide which markets to work, what to spend and which contracts to sign. You are responsible for the outcome of those decisions.
12. Ad platforms and third-party services
12.1 No affiliation. REI Cash Index is not part of, affiliated with, sponsored by or endorsed by Meta Platforms, Inc., Facebook, Google LLC, Google Ads or any data provider. Their names and marks belong to their owners.
12.2 Your ad accounts. You run your own ad accounts and are responsible for every ad you publish. Your ads must follow each platform's policies, including its rules for housing and real estate ads. We are not responsible for rejected ads, account restrictions or suspensions.
12.3 Export formats. Exports are formatted to match ad platforms' bulk location tools as we understand them. Platforms change their formats, and we do not guarantee that every city will match.
12.4 Third-party services. The Service relies on outside providers for hosting, checkout, payments, email and similar functions, and may link to outside websites. Their terms and privacy policies govern their services. We are not responsible for them.
13. Communications
13.1 Service messages. We send account, billing and service emails to the address on your account. You cannot opt out of these while you have an account.
13.2 Marketing email. We may send marketing email. You can unsubscribe at any time with the link in any marketing email.
13.3 Calls and texts. We call or text you for marketing only if you gave consent on one of our forms. Consent is not a condition of any purchase. Message frequency varies, and message and data rates may apply. Reply STOP to a text to opt out, or HELP for help. You can also opt out by emailing support@reicashindex.com.
13.4 Privacy. Our Privacy Policy explains what personal information we collect and how we use it.
13.5 Electronic records. You agree that we can send notices, disclosures and agreements electronically, and that they have the same effect as paper copies.
14. Intellectual property and feedback
14.1 Our property. The Service, including its software, design, text, rankings, methods, compiled datasets, ad kits and courses, and the REI Cash Index name and logo, belongs to us or our licensors. It is protected by copyright, trademark and other laws.
14.2 No transfer. You receive only the licenses stated in these Terms. We reserve all other rights. You may not use our name or logo without written permission.
14.3 Feedback. If you send ideas or suggestions, we may use them without restriction or payment.
14.4 Information you submit. You keep ownership of information you submit, such as cost-per-lead reports. You grant us a perpetual, worldwide, royalty-free license to use it to operate and improve the Service, and to publish it in aggregated form that does not identify you.
15. Disclaimer of warranties
15.1 As is. THE SERVICE, DATA, AD KITS, COURSES AND API ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
15.2 No promise of availability. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any data or estimate will be accurate or produce any result.
15.3 State law. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.
16. Limitation of liability
16.1 Excluded damages. TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR OWNERS, EMPLOYEES AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. THIS INCLUDES LOST PROFITS, LOST DEALS, LOST ASSIGNMENT FEES, WASTED AD SPEND, LOST DATA AND LOSS OF GOODWILL, EVEN IF WE WERE TOLD THE DAMAGE WAS POSSIBLE.
16.2 Cap. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) $100.
16.3 Basis of the bargain. These limits apply to every kind of claim, whether in contract, tort or otherwise. Our prices reflect them. Some states do not allow some of these limits, so parts of this section may not apply to you.
17. Indemnification
You agree to defend, indemnify and hold harmless In House Lead Gen LLC and its owners, employees and contractors from any claim, loss, liability and expense, including reasonable attorneys' fees, that arises from:
- your use of the Service, ad kits, courses or API;
- your advertising, marketing, calls, texts or emails;
- your real estate transactions and contracts;
- your breach of these Terms; or
- your violation of any law or of another person's rights.
18. Suspension and termination
18.1 By you. You can stop using the Service at any time. Cancel your membership as described in section 5.1.
18.2 By us. We may suspend or end your access if you breach these Terms, fail to pay, misuse the Service, or create risk or legal exposure for us. Where practical, we will tell you why and give you a chance to fix the problem.
18.3 Refunds on termination. If we end your membership for a breach, you are not entitled to a refund. If we end it for any other reason, we will refund the unused part of your current paid period.
18.4 After termination. Your license to the Service ends. Ad kits you already bought remain licensed under section 6 unless we ended your account for misusing them.
18.5 Survival. Sections 6.5, 7.3, 9 through 12, 14 through 17, 19, 20 and 22 survive termination.
19. Dispute resolution and arbitration
19.1 Talk to us first. Before starting any formal claim, email support@reicashindex.com with your name, account email, a description of the dispute and what you want. We will send any notice to you at your account email. Both sides will try in good faith to settle the dispute for 30 days.
19.2 Agreement to arbitrate. IF WE CANNOT SETTLE A DISPUTE WITHIN 30 DAYS, YOU AND WE AGREE THAT ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICE WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, AND NOT IN COURT, EXCEPT AS STATED IN SECTION 19.7.
19.3 Rules. The American Arbitration Association (AAA) will administer the arbitration under its rules in effect when the claim is filed. One arbitrator will decide. The Federal Arbitration Act governs this section. Hearings will take place by video or phone unless the arbitrator requires otherwise. If an in-person hearing is needed, it will be held in Wyoming or another location both sides agree on.
19.4 Fees. The AAA rules decide who pays filing, administrative and arbitrator fees. Each side pays its own attorneys' fees unless the arbitrator awards them under applicable law.
19.5 Class action and jury waiver. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR JOIN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS. The arbitrator may not combine more than one person's claims.
19.6 Your right to opt out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms. Email support@reicashindex.com, or write to In House Lead Gen LLC, 30 N Gould St, Suite R, Sheridan, Wyoming 82801, with your name, account email and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
19.7 Exceptions. Either side may bring an individual claim in small claims court if it qualifies. Either side may also go to court for an injunction to stop misuse of intellectual property or unauthorized use of the Service.
19.8 Time limit. To the extent the law allows, any claim must be filed within one year after it arose, or it is permanently barred.
19.9 If part of this section fails. If the class action waiver in section 19.5 is found unenforceable for a claim, that claim proceeds in court and the rest of this section stays in effect.
20. Governing law and venue
The laws of the State of Wyoming govern these Terms, without regard to conflict-of-law rules. Any dispute that is not subject to arbitration will be heard only in the state or federal courts located in Wyoming. You and we consent to those courts' jurisdiction.
21. Changes to the Service and these Terms
21.1 Service changes. We may add, change or remove features, data fields, products and prices. If we remove a core part of a paid plan, you can cancel and section 18.3 applies.
21.2 Changes to the Terms. We may update these Terms. For a material change, we will email you or post a notice in the members area at least 14 days before it takes effect. The new effective date will appear at the top.
21.3 Your choice. If you do not agree to a change, cancel before it takes effect. Using the Service after the effective date means you accept the updated Terms.
22. General terms
22.1 Entire agreement. These Terms, the Privacy Policy, the Refund Policy and the terms shown at checkout are the entire agreement between you and us about the Service. If they conflict, the checkout terms control for price and billing period, and these Terms control for everything else.
22.2 Severability. If a court or arbitrator finds part of these Terms unenforceable, the rest stays in effect.
22.3 No waiver. If we do not enforce a right, we have not waived it.
22.4 Assignment. You may not transfer your account or these Terms without our written consent. We may assign them in a merger, sale or reorganization.
22.5 Events beyond our control. We are not liable for delays or failures caused by events outside our reasonable control, such as outages at hosting, payment or data providers.
22.6 Independent parties. These Terms do not create a partnership, joint venture, employment or agency relationship.
22.7 Notices. We send notices to your account email. Send notices to us at the addresses in section 23.
